In general, lemons are cars under warranty with serious issues despite a reasonable number of attempts to fix it

The federal government, and each individual state has consumer protection laws that cover your faulty car. In California, we have one of the strongest laws, best for consumers. New cars are expected not to have any serious issues. By selling the car, the manufacturer agrees to that expectation. Unfortunately, some cars have defects while under warranty that don’t seem like they’re able to be fixed. Lemon laws are for your protection to give you a way out of your repeating cycle of stress and car repairs. The Song-Beverly Consumer Warranty Act, California’s Lemon Law, applies to all consumer goods under warranty. This includes all types of vehicles. The Magnuson-Moss Federal Warranty Act, Federal lemon law, protects buyers of all types of products that are under written warranty.

Lemon Law not only covers new cars, but all cars that are under warranty. There are several warranties that could cover your car:

  • The manufacturer’s warranty–Often good for 18,000 miles or 18 months, whichever comes first
  • Powertrain warranty–extended warranty for up to 10 years, even if there’s been a change in ownership
  • Dealer’s written warranty–for used cars at a dealership, there’s often a buyer’s guide displayed with an option for “Warranty”. If this option was chosen, your dealer’s warranty will qualify your vehicle under California Lemon Law
  • CPO Warranty–for Certified pre-owned vehicle
